California Privacy Rights Policy

New PBS Brand Co., LLC and its affiliated entities (“we,” “us,” “our”) are committed to letting you know how we will collect and use your information. This California Privacy Rights Policy supplements the Punch Bowl Social and The Agave Room Website Privacy Policy (“Privacy Policy”) and contains the disclosures required under the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA”). For individuals who are California residents, the CCPA requires certain disclosures about the categories of personal information we collect and how we use it, the categories of sources from whom we collect personal information, and the third parties with whom we share it. Capitalized terms in this California Privacy Rights Policy have the meanings given to them in the Privacy Policy.

This California Privacy Rights Policy does not apply to information collected by third-party websites that may be linked to or from the Services. We are not responsible for the actions and privacy policies of third parties.

We reserve the right to modify the terms of this California Privacy Rights Policy from time to time. We will post any changes, and such changes will become effective when they are posted.

NOTICE AT COLLECTION

We collect information from users as described in our Privacy Policy. The personal information as defined in California Civil Code Section 1798.140(v)(1)(A) to (K), we may collect includes:

  • Identifiers such as name, address, email address, phone number, general contact information, company name, payment information, internet protocol (IP) address, and device identifiers.
  • Personal information described in California Civil Code Section 1798.80(e) such as the identifiers listed above.
  • Commercial information such as the occasion for a reservation, special requests for a reservation, event details, visit frequency, date and time of visit, surveys and promotions in which you have participated, the products and services you have purchased, and credit card and other payment information.
  • Characteristics of Protected Classifications such as gender, age, race, disability status, sexual orientation, gender identity, military/veteran status, marital status, national origin, and medical information that you provide in connection with a job application or some other interaction with us.
  • Internet or other electronic network activity information such as browsing history, search history, and information regarding a consumer’s interaction with an internet website application or advertisement.
  • Audio, electronic, visual, thermal, olfactory, or similar information collected from security cameras or if you use one of our photobooths.
  • Professional or employment-related information such as information provided when an applicant applies for a job with us online.
  • Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g; 34 C.F.R. Part 99) when an applicant applies for a job with us online.
  • Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We collect these categories of personal information for the following purposes:

  • Provide Products and Services: We use your information to provide Services and complete transactions; provide requested or personalized content; take your reservation; market or sell gift certificates or other products;
  • Personalize Our Services: We use your information to help us personalize and continually improve your experience using our Services;
  • Communications: We use your information to communicate with you and respond to inquiries and provide customer service;
  • Job Applications: If you are applying for a job, we use your information you submit to process your employment application and in connection with your employment if you are hired.
  • Improve and Develop Our Services. We use your information to: (a) ensure our Site and Services are working as intended; (b) operate our business; (c) better understand how users access and use our Site and Services, both on an aggregated and individualized basis, (d) develop, maintain, protect and improve our Site and Services; and (e) perform research and analytics, including to analyze and report on usage and performance of our Sites and Services.
  • Marketing and Promotions. We use your personal information for marketing and promotional purposes. For example, we may use your personal information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you or direct targeted advertising to you or to conduct surveys or sweepstakes or similar promotions. If you sign up for text or SMS messages, we use your phone number and other personal information to send you texts or SMS message regarding your regarding a reservation or promotions or other offerings.
  • Sale and Share for Targeted Advertising and Cross-Context Behavioral Advertising. We do not sell your personal information as such term is defined in applicable data privacy laws but may share your personal information with third parties for targeted advertising or cross-context behavioral advertising. Please see the below for your ability to opt-out of such advertising.
  • Compliance. We may use your personal information to: (a) detect, investigate, and prevent activities on our Sites that may violate our terms or policies, could be fraudulent, pose a security threat, violate copyright or other rules, or that may be otherwise illegal, (b) comply with legal requirements, (c) defend or exercise legal claims, (d) respond to law enforcement or governmental investigations or requests, and (e) protect our rights and the rights and safety of our users and others.

We may also use or combine information that we collect through the Services with other information we obtain to enhance, expand, check the accuracy of our records, and to provide you with more personalized services, offers, and promotions. We do not sell this personal information but may share it to the following third parties for cross-context behavioral advertising: advertising networks and social networks. You have a right to opt-out of the sharing of your personal information for cross-context behavioral advertising by clicking here or emailing us at privacy@punchbowlsocial.com.

We may also disclose it to service providers, such as internet service providers, data analytics providers, and operating systems and platforms to fulfill certain business purposes, as outlined in our Privacy Policy.

RETENTION

We will generally store and use your information only for as long as is necessary for the uses or purposes for which we collected the information as described in our Privacy Policy, and to the extent required by law, we will delete or make inactive information for customers that have been inactive. We may retain your personal information for longer periods if required by law.

NOTICE OF PERSONAL INFORMATION WE HAVE COLLECTED IN THE LAST TWELVE MONTHS

Please note that for purposes of this California Privacy Rights Policy, personal information does not include publicly available information from government records or made publicly available by you such as on social media sites, pr deidentified or aggregate consumer information, and personal information excluded from the CCPA.

We collect the personal information listed above from the following categories of sources:

  • Directly from you, including through your use of our Services which may include the website sign-up forms, OpenTable reservation platform, photobooths, Adentro in-store Wi-Fi, and Triple Seat event request submission.
  • From service providers, social networks and data analytics providers.
  • Automatically collected from you though cookies or Tracking Technologies.

NOTICE OF OUR USE OF PERSONAL INFORMATION FOR BUSINESS OR COMMERCIAL PURPOSES IN THE LAST TWELVE MONTHS

For each of the above categories, we use the personal information we collect for the commercial and business purposes disclosed within our Privacy Policy and as set forth above in the Notice at Collection. We may also use or combine information that we collect through the Services with other information we obtain to enhance, expand, check the accuracy of our records, and to provide you with more personalized services, offers, and promotions.

SALE OR SHARING OF PERSONAL INFORMATION IN THE LAST TWELVE MONTHS

In the last twelve months we have not sold personal information identified in the above categories to any third party. We have shared personal information with advertising networks and social networks for cross-context behavioral advertising. Furthermore, we have not sold or shared and do not sell or share personal information of consumers under 16 years of age.

DISCLOSURE OF PERSONAL INFORMATION IN THE LAST TWELVE MONTHS

In the last twelve months we have disclosed your personal information collected to our service providers, advertising networks, affiliates, partners, and other entities for the business and commercial purposes as described below.

Service Providers: We engage the following types of vendors to perform functions on our behalf such as: customer information management, customer communications and marketing services, billing and collection, order fulfillment, auditing and accounting, job application processing, professional services/consultants, analytics services, security services, and IT support. These companies are restricted from using your information in any manner other than in helping us to deliver or provide you our services. There are limited circumstances in which the service provider collects data directly from you when their privacy policies may also apply.

Social Media Platforms: Where you choose to interact with us through social media, your interaction with these programs typically allows the social media company to collect some information about you through digital cookies they place on your device and other tracking mechanisms they place on your device. In some cases, the social media company may recognize you through its digital cookies even when you do not interact with their application. Please visit the social media companies’ respective privacy policies to better understand their data collection practices and the controls they make available to you.

Companies Involved in Advertising: We partner with companies that assist us in advertising about our Services to others who may be interested in the Services. These companies may use Tracking Technologies on our website to collect or receive information from the Services and elsewhere on the Internet and use that information to provide measurement services and target ads.

Corporate Affiliates: We share data with other members of our group of companies to use in a manner consistent with and for the purposes set forth in this California Privacy Rights Policy.

Law Enforcement, Legal Process, and Emergency Situations: We may also use or disclose information if required to do so by law or on the good-faith belief that such action is necessary to: (a) conform to applicable law, comply with legal process served on us, or in response to requests from law enforcement or regulatory authorities; (b) protect and defend our rights or property, the website, the Services, or our users, or (c) act to protect the personal safety of us, users of the website and Services, or the public.

CALIFORNIA RIGHTS AND CHOICES

If you are a California resident, you have certain rights related to your personal information. Except as otherwise provided by applicable law, you may exercise the following rights free of charge with respect to the personal information covered by this Privacy Policy. We endeavor to respond to your request promptly upon verification and as required by applicable law.

(i) Right to Know

You have the right to request that we disclose personal information that we have collected, sold, or shared about you, including:

  • The categories of personal information;
  • The categories of sources from which the personal information is collected;
  • The business or commercial purpose for collecting, selling, or sharing personal information;
  • The categories of third parties to whom we disclose personal information; and
  • The specific pieces of information we have collected about you.

(ii) Right to Correction

You have the right to request that we correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.

(iii) Right to Deletion

You have a right to request that we delete any personal information about you that we have collected directly from you, subject to certain exceptions.

(iv) Right to Opt-Out of Sale/Sharing

You have a right to opt-out of the sharing of your personal information because, within the meaning of the CCPA, we may share personal information identified in the above categories for purposes of cross-context behavioral advertising. You may exercise your right to opt-out of the sharing of your personal information by submitting a request at the following link or emailing us at privacy@punchbowlsocial.com. You may also choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). We will process the GPC signal as a request to opt out.

We do not offer a right to opt-out of the sale of your personal information because, within the meaning of the CCPA, we do not sell and have not sold personal information identified in the above categories to any third party within the last twelve months.

(v) Right to Limit Use and Disclosure of Sensitive Personal Information

We do not offer a right to limit the use or disclosure of sensitive personal information because, within the meaning of the CCPA, we do not use sensitive personal information for inferring characteristics.

(vi) Right to Non-Discrimination for Exercise of a California Privacy Right

You have a right to not receive discriminatory treatment by us for the exercise of privacy rights conferred by the CCPA, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their CCPA rights.

(viii) Verifiable Request

As required and to the extent permitted under applicable law, we take steps to verify your identity before granting you access to information or acting on your request to exercise your rights. We may require you to provide information sufficient to allow us to reasonably verify you are the person about whom we collected personal information or an authorized representative and to describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We may limit our response to your exercise of the above rights as permitted under applicable law.

(ix) Agent Authorization

You may designate an authorized agent to make a request on your behalf. You may make such a designation by providing the agent with written permission to act on your behalf. As permitted by law, we may require additional verification in response to a request even if you choose to use an agent. We may refuse a request if the agent does not provide adequate proof of their authorization. You may also make a verifiable consumer request on behalf of your minor child.

OTHER IMPORTANT INFORMATION

Users Under Sixteen: Our website is intended for users aged 16 and older only. Accordingly, we will not knowingly collect or use any personal information from children under the age of 16. If we become aware of personal information in our database that was collected from a child under 16, we will delete that information.
