This Privacy Policy applies when you use or interact with our website at https://punchbowlsocial.com and other websites on which this policy is posted (“Sites”), our mobile applications or other online services, through email or other forms of communications, to make a purchase or enter into other transaction with us, visit one of our locations, or attend an event or participate in a promotion sponsored by us (collectively, the “Services”). We have established this Privacy Policy to let you know the kinds of information we may gather when you use our Services, why we gather your information, how we use your information, when we might disclose your information, and how you can manage your information.

This Privacy Policy does not apply to information collected by third-party websites that may be linked to or from the Services. We are not responsible for the actions and privacy policies of third parties.

We reserve the right to modify the terms of this Privacy Policy from time to time. We will post any changes, and such changes will become effective when they are posted.

INFORMATION COLLECTED AND STORED

We collect personal information about you directly from you and from third parties, as well as automatically through your use of our Services. “Personal information” for purposes of this Privacy Policy means information that is protected as personal information or personal data under laws applicable to us.

Information We Collect Directly from You and Third Parties. We collect personal information directly from you in several ways:

  • Registration or Use of Services: When you complete a contact form on our Sites or download or register to use our Services or request to book a reservation or plan a party or other event at one of our locations or participate in a promotion or survey, we may collect your name, address, contact information, company information, payment information, occasion for reservation, special requests for reservation , event details, visit frequency, and date and time of visit.
  • Commercial Information: When you purchase a product or Service from one of our locations, we collect information about the products and Services you purchased and credit card and other payment information that is processed by our third-party payment processors. We may also collect information about your interests and consuming history or tendencies, such as products or Services considered or information provided in response to surveys or other research conducted on our behalf and information you provide in public forums or in connection with our sweepstakes and other promotions.
  • Security Cameras and Photobooths: Our locations will have security cameras that record activities and visitors to our locations for monitoring, safety, and security purposes. We also offer photobooths which may collect your image and other information if you choose to use them.
  • Geolocation: If you have provided permission to allow us to collect location information, we may obtain your physical location information in terms of latitude and longitude from technologies like GPS, Wi-Fi, or cell tower proximity. You are able to withdraw your permission for us to acquire such physical location information from your mobile device through your browser settings, although we do not control this process.
  • Wi-Fi: Our locations may offer visitors access to our Wi-Fi network. In such a case, we may collect your name, email address, and phone number. These services are provided by Adentro. Please review their privacy policy when signing up for Wi-Fi.
  • Job Applicant Data: If you submit a job application through our Services, we collect your contact and professional information, including your resume with educational and work background. This information is processed through our third-party platform Paylocity.
  • Contract and Payment Data: We may receive contract details (like signatures) from you or your organization and use third party payment processing services to collect payment and billing information, which may contain personal information such as billing name, billing address, and payment card details, in connection with purchasing products and services at our location or planning a party or visit.

In addition, if you are providing personal information for third parties in connection with using our Services, you are responsible for ensuring that you have all required permissions and consents to provide such personal information to us for use in connection with the Services and that our use of such personal information to provide the Services does not violate any applicable law, rule, regulation, or order.

Information We Collect Automatically. We may automatically collect the following information about your use of our Sites or Services through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; your device ID; your advertising ID; the length of time you visit our Sites or use our Services; and the referring URL, or the webpage that led you to our Sites. We may combine this information with personal information that we have collected about you, including, where applicable, your name and other personal information. USE OF YOUR INFORMATION

We use the personal information we collect about you for the following purposes:

  • Provide Products and Services: We use your information to provide Services and complete transactions; provide requested or personalized content; take your reservation; and market or sell gift certificates or other products.
  • Personalize Our Services: We use your information to help us personalize and continually improve your experience using our Services.
  • Communications: We use your information to communicate with you and respond to inquiries and provide customer service.
  • Job Applications: If you are applying for a job, we use your information to process your employment application and in connection with your employment if you are hired.
  • Improve and Develop Our Services. We use your information to: (a) ensure our Sites and Services are working as intended; (b) operate our business; (c) better understand how users access and use our Sites and Services, both on an aggregated and individualized basis; (d) develop, maintain, protect, and improve our Sites and Services; and (e) perform research and analytics, including to analyze and report on usage and performance of our Sites and Services.
  • Marketing and Promotions. We use your personal information for marketing and promotional purposes. For example, we may use your personal information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you or direct targeted advertising to you or to conduct surveys or sweepstakes or similar promotions.
  • Sale and Share for Targeted Advertising and Cross-Context Behavioral Advertising. We do not sell your personal information as such term is defined in applicable data privacy laws but may share your personal information with third parties for targeted advertising or cross-context behavioral advertising. Please see below for your ability to opt-out of such advertising.
  • Compliance. We may use your personal information to: (a) detect, investigate, and prevent activities on our Sites that may violate our terms or policies, could be fraudulent, violate copyright or other rules, or that may be otherwise illegal, (b) comply with legal requirements, (c) defend or exercise legal claims, (d) respond to law enforcement or governmental investigations or requests, and (e) protect our rights and the rights and safety of our users and others.

We may also use or combine information that we collect through the Services with other information we obtain to enhance, expand, and check the accuracy of our records, and to provide you with more personalized Services, offers, and promotions.

DISCLOSURE OF YOUR INFORMATION

We disclose your information collected to our service providers, affiliates, partners, and other entities, as described below.

Service Providers: We engage the following types of vendors to perform functions on our behalf such as: customer information management, customer communications and marketing services, billing and collection, order fulfillment, auditing and accounting, professional services/consultants, analytics services, security services, and IT support. These companies are restricted from using your information in any manner other than in helping us to deliver or provide you our Services. There are also some circumstances in which the service provider collects data directly from you when their privacy policies may also apply.

Social Media Platforms: Where you choose to interact with us through social media, your interaction with these programs typically allows the social media company to collect some information about you and your interaction with our Services through digital cookies they place on your device and other tracking mechanisms they place on your device. In some cases, the social media company may recognize you through its digital cookies even when you do not interact with their application. Please visit the social media companies’ respective privacy policies to better understand their data collection practices and the controls they make available to you.

Companies Involved in Advertising: We partner with companies that assist us in advertising about our Services to others who may be interested in the Services on social media platforms and other forms of media. These companies may use Tracking Technologies (defined below) on our Sites to collect or receive information from the Services and elsewhere on the Internet and use that information to provide measurement services and target ads.

Corporate Affiliates: We share data with other members of our group of companies to be used in a manner consistent with this Policy.

Corporate Transactions: We may change our ownership or corporate organization while providing the Services or Sites. We may also sell certain assets associated with the Services or Sites or our business. In such events, we may transfer some or all of your information to an entity acquiring all or part of our assets or to another entity with which we have merged or the successor to our business, including in connection a bankruptcy proceeding. COOKIES AND INTEREST-BASED ADVERTISING

We use cookies and other tracking mechanisms, such as web beacons, to track information about your use of our Services. We may combine this information with other personal information we collect from you (and our third-party service providers may do so on our behalf).

Currently, our systems do not recognize browser “do-not-track” requests. Necessary

Necessary cookies are required to enable the basic features of this site, such as providing secure log-in or adjusting your consent preferences. These cookies do not store any personally identifiable data. These cookies are always active.

Advertisement

You may always opt out of receiving future email marketing messages from Punch Bowl Social and The Agave Room. We provide you with the opportunity to opt out of such communications by clicking the “unsubscribe” link at the bottom of each marketing email. Please note that you may not opt out of our service-related communications.

HOW WE SECURE YOUR INFORMATION

We take reasonable security measures to help protect the personal information collected through our Services. Please understand, however, that no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.

You can help protect the privacy of your own information by using encryption and other techniques to prevent unauthorized interception of your personal information.

OTHER IMPORTANT INFORMATION

Users Under Sixteen: Our Sites are intended for users aged 16 and older only. Accordingly, we will not knowingly collect or use any personal information from children under the age of 16. If we become aware of personal information in our database that was collected from a child under 16, we will delete that information.

Users Outside of the United States: If you use our Sites or Services outside of the United States, you understand and consent to the transfer of your personal information to, and the collection, processing, and storage of your personal information, in the United States and elsewhere. The laws in the United States and these countries regarding personal information may be different and may offer less protection than the laws of your country.

YOUR CALIFORNIA AND OTHER STATE PRIVACY RIGHTS

California Shine the Light Privacy Rights: We do not disclose your personal information to unaffiliated third parties for those third parties’ direct marketing purposes unless you affirmatively agree to such disclosure.

Nevada Residents: Residents of the State of Nevada have the right to opt out of the sale of certain pieces of their information to other companies who will sell or license their information to others. Other States: Residents of certain other US States where we have locations (including Colorado, Minnesota, Oregon, and Texas) have rights relating to the collection, use, disclosure, and other processing of their personal information, subject to applicable legal exceptions and requirements. Certain states permit you to use an authorized agent to submit a request to know or an access, deletion, correction, or opt-out request on your behalf. Authorized agents may submit such requests at privacy@punchbowlsocial.com. Authorized agents can make a request on your behalf if we are provided with verification of your identity and confirmation that you provided the agent authority to act on your behalf.

We will use reasonable efforts to accommodate such requests, to the extent required by law, provided that we may be required to retain personal information to comply with legal obligations, accounting requirements, or for other business purposes. Punch Bowl Social Text Message Communication Policy

1. Purpose
This policy outlines the terms under which customers may opt in to receive text message communications from Punch Bowl Social. It ensures compliance with applicable laws, including the Telephone Consumer Protection Act (TCPA) and relevant regulations, to protect customer rights and provide transparency.

2. Types of Communication
Customers who opt in may receive the following types of text messages:

  • Transactional notifications (e.g., reservation confirmations, event updates)
  • Account alerts and security notifications
  • Promotional offers, discounts, and marketing messages
  • Surveys and feedback requests
  • Customer support and service updates

3. Opt-In Consent
Customers must provide explicit consent to receive text messages from Punch Bowl Social. Consent can be given by:

“You have been unsubscribed from Punch Bowl Social texts. No more messages will be sent. For additional assistance, contact (720) 458-1514 | privacy@punchbowlsocial.com.”

5. Frequency of Messages
Message frequency varies based on the type of communication and customer engagement but will generally not exceed 4 messages per month.

6. Message and Data Rates
Standard message and data rates may apply based on the customer’s mobile carrier plan. Punch Bowl Social is not responsible for any additional charges incurred by the customer.

7. Opt-Out Process
Customers can opt out at any time by replying “STOP” to any received text message or contacting Punch Bowl Social at (720) 458-1514 | privacy@punchbowlsocial.com to request removal from text communications.

8. Privacy and Data Security
Punch Bowl Social will handle customer data in accordance with our Privacy Policy, ensuring that information collected during the opt-in process and communication exchanges is securely stored and only used for permitted purposes.

Notwithstanding anything to the contrary in this privacy policy, your consent to receive SMS messages applies solely to us. It does not apply to the activities of any third party. We will not share your mobile number with any third party for their marketing or promotional purposes.

9. Changes to the Policy
Punch Bowl Social reserves the right to modify this policy at any time. Customers will be notified of significant changes via [website updates, email, or text message]. Continued receipt of text messages following policy updates constitutes agreement to the revised terms.
